ALKE-BLACK Terms & Conditions

Version 1.0 — Effective upon use of the platform

By accessing or using ALKE-BLACK, you agree to these Terms & Conditions. If you do not agree, you must not use the platform.

1) About ALKE-BLACK

ALKE-BLACK is a curated online marketplace that connects buyers with independent brand owners (“Brands”). ALKE-BLACK provides platform infrastructure for listings, payments, and delivery coordination.

2) Platform Role

ALKE-BLACK is a marketplace platform and is not the seller of products unless explicitly stated. Brands are responsible for the products they list, including quality, accuracy, legality, and fulfilment.

3) User Accounts

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login details.
ALKE-BLACK may suspend or terminate accounts that violate these Terms.

4) Buyers

Buyers agree to provide accurate delivery and contact information.
Orders are only confirmed after successful payment verification.
Buyers must use the platform respectfully and lawfully.

5) Brands

Brands operate on ALKE-BLACK subject to a separate Brands Agreement. Acceptance of the Brands Agreement is mandatory for seller access and operations.

Brands approval is at ALKE-BLACK’s discretion.
ALKE-BLACK may pause or remove brands to protect platform integrity.

6) Orders & Payments

Payments are processed through approved payment partners.
Orders are considered valid only after payment confirmation.
ALKE-BLACK may cancel or delay orders in cases of verification or operational issues.

7) Shipping & Delivery

Delivery is coordinated through third-party courier services. Estimated delivery times are not guarantees. ALKE-BLACK is not responsible for courier delays beyond reasonable control.

8) Returns & Refunds

Returns and refunds are governed by the Refund Policy and applicable South African consumer protection laws.

9) Platform Rules & Conduct

Users must not engage in fraud, abuse, or platform manipulation.
Offensive, misleading, or illegal content is prohibited.
ALKE-BLACK may remove content or restrict access to enforce platform rules.

10) Intellectual Property

All platform branding, design, and systems belong to ALKE-BLACK.
User-submitted content remains owned by the creator but may be displayed by ALKE-BLACK.

11) Limitation of Liability

To the maximum extent permitted by law, ALKE-BLACK is not liable for indirect, incidental, or consequential damages arising from platform use, seller conduct, or courier performance.

12) Suspension & Termination

ALKE-BLACK may suspend, restrict, or terminate access to the platform where necessary to protect users, sellers, or platform integrity.

13) Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be handled within South African jurisdiction.

14) Updates to These Terms

ALKE-BLACK may update these Terms from time to time. Continued use of the platform after updates constitutes acceptance of the revised Terms.
